JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code and Section 25 (1-b) A of the Arms Act.
Allegation against the petitioner is that he along with other accused snatched Rs. 500/- from the informant and on raising alarm the petitioner fled away and the co-accused was apprehended by the nearby people.
It has been submitted on behalf of the petitioner that he is in custody since 24.2.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has been named in the F.I.R on the statement of the co-accused. No arms is said to have been recovered from the possession of the petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.26373 of 2016 (3) dt.23-08-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria (R.S.) P.S. Case no. 44 of 2016.
