The petitioner seeks bail in Shakurabad P.S. Case No.136 of 2014 registered under Sections 147, 148, 384, 385, 435, 341 of the Indian Penal Code and Section 17 of the C.L.A. Act. As per the prosecution case, 6-7 unknown miscreants are said to have torched the road roller machine of a Construction Company for non-payment of the extortion money. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. Similarly situated co-accused persons, namely, Anil Paswan, Baban Paswan and Ravindra Prasad @ Ravindra Yadav @ Doctor have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No.20913 of 2015, Cr. Misc. No.21031 of 2015 and Cr. Misc. No.37315 of 2015 respectively. The petitioner has been languishing in custody since 18.07.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-4, Jehanabad in connection with Shakurabad P.S. Case No.136 of 2014.
