JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 24.06.2014 in connection with Sultanganj P.S. Case No. 112 of 2014 for the offences instituted under Section 302/34 IPC. The prosecution story, in brief, is that the petitioner alongwith others indulged into altercation, abuse followed by assault and thereafter they caught hold of the brother of the informant and brutally assaulted him confining in a room and ultimately killed him.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 24.06.2014 and the charge sheet has been submitted

Patna High Court Cr.Misc. No.29543 of 2015 (4) dt.24-11-2015 2/2 in the case. There is no allegation of tampering of the evidence against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. Other co-accused has been granted bail by this Court vide Cr. Misc. No. 3023/2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhagalpur, in connection with Sultanganj P.S. Case No. 112/2014(G.R. No. 1617/2014).
