Petitioner seeks bail in a case registered for the offence punishable under Section 397 of the Indian Penal Code. The FIR is against unknown. Name of the petitioner has transpired subsequently.

Submission of the petitioner is that informant is not an eye-witness of the occurrence. No other eye-witness has supported the allegation against the petitioner. Though the petitioner is in custody in connection with some other cases from 2010, in the present case, the petitioner was remanded on 25.08.2012. However, the trial has not been begun as yet.

The record reveals that the petitioner is accused in other cases wherein the petitioner claims to be on bail.

Tr. No. 51 of 2015/126 of 2016 arising out of Turkaulia Police Station Case No. 131 of 2014.
