This is an application for bail in connection with Gopalpur P.S. Case No. 143 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 506 of the Indian Penal Code and 25(1-B)(a), 26)i), 27 and 35 of the Arms Act. Allegation against the accused persons, including the petitioner is of firing indiscriminately on the informant and petitioner is accused in six other cases.

Submission of learned counsel for the petitioner is that he has been made accused due to rivalry in the Pramukh election and there is nothing against him and nobody was sustained injury and he is in custody for 10 months.

No.42852 of 2017 (3) dt.18-10-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Naugachia, Bhagalpur, in connection with Gopalpur P.S. Case No. 143 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall mark his attendance in local police station in first week of every month for a period of one year so that police may watch his conduct during that period, failing which his bail bond shall be cancelled.

Let a copy of this order be communicated to the Superintendent of Police, Bhagalpur for compliance of this order. (Vinod Kumar Sinha, J) spal/- U
