JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier the prayer for anticipatory bail of the petitioner was disposed of with direction to petitioner to surrender before the court below within a period of four weeks and pray for regular bail, which will be considered by the court below on the merit of the case and the court below was directed to dispose of the prayer for regular bail of the petitioner, if possible, on same day.

Allegation against the petitioner that he is running the clinic without having valid license issued by the Clinical Establishment.

Petitioner has filed this anticipatory bail petition on the ground that petitioner is the owner of the house, in which, the alleged clinic was being run and petitioner has nothing to do with

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and pray for regular bail and also produce the papers in support of his contention that he is not the owner of the said clinic and he has given the same on rent and if such papers are being filed, the court below after verifying the same shall consider the prayer for regular bail of the petitioner and dispose of the same, if possible on same day.
