JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Barun P.S. Case No. 214 of 2014 registered for offences punishable under Section 25(1-b) a and 26 Arms Act.
Allegation against the petitioner is that while the informant was on patrolling duty, he came to know that a loot had been committed on a sand Ghat on the point of firing. When the informant reached the spot he found a person injured and he had a country made pistol and six cartridges.
Learned counsel for the petitioner submitted that he is not named in the FIR, it transpired during the course of investigation and confessional statement of co-accused. The petitioner has been in custody for about two months.

Having heard both sides and considering the aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad, in connection with Barun P.S. Case No. 214 of 2014, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not adduce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
