JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The alleged occurrence took place in the year 2006 but petitioners could be remanded in this case in the year 2015. It is pointed out on behalf of the petitioners that some co-accused have already been acquitted whereas petitioners are languishing in jail custody since 02.05.2015. Regard being had to the fact and circumstances as well as submissions of the parties, I am not inclined to release the petitioners on bail at least, at this stage. Accordingly, the prayer for bail of the petitioners in connection with session trial no. 557 of 2009 arising out of Runnisaidpur P.S.Case No. 90 of 2006,
Patna High Court Cr.Misc. No.31047 of 2015 (3) dt.14-10-2015 2/2 pending in the court of Additional District Judge 1st , Sitamarhi, stands rejected.
However, petitioners may renew their prayer for bail after six months, if their trial is not concluded within the above stated period of six months.
