JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Munger Mahila P.S. Case No. 23 of 2016, registered for offences punishable under Sections 376, 354, 504, 506, 323/34 of Indian Penal Code.
Allegation against the petitioner is of committing rape on the informant.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and there was love affair between the parties and a panchayati was held in which the petitioner was asked to pay 80,000/- and when petitioner could not fulfill their demand, present false case has been lodged. Further petitioner was also assaulted brutally. Petitioner has been in custody since 30.09.2016.
Patna High Court Cr.Misc. No.42910 of 2017 (3) dt.08-11-2017 2/2 Learned counsel for the State opposed the prayer for bail and submitted that the girl in her statement recorded under Section 164 Cr.P.C. has named this petitioner.
Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of Seven months. At the same time, S.P. Munger is also directed to ensure the production of witnesses in the Trial Court so that the trial can be concluded within the aforesaid period. (Vinod Kumar Sinha, J) sunil/- U T
