15-09-2017 Heard Sri Manoj Kumar, learned counsel assisted by Sri Karandeep Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 19-07-2017 in Madhuban P.S. Case No. 136 of 2017 registered for offence under Sections 272, 273, 188 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on accusation of recovery of huge quantity of toddy from verandah of the petitioner, he has been made accused and he is languising in jail since long, whereas, the petitioner is having clean antecedent and this fact has been stated in paragraph - 3 of the petition.
Patna High Court Cr.Misc. No.41735 of 2017(2) dt.15-09-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Surendra Choudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise Act, East Champaran at Motihari in connection with Madhuban P.S. Case No. 136 of 2017.
