The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 504, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act.
For land dispute on the order of petitioner No.1, Gauri Shankar Sah petitioner No.2, Dashrath Sah took out his pistol and handed over to Fanta Paswan and thereafter, Fanta Paswan fired which got missed and then co-accused, Deepak Singh allegedly assaulted with butt of the pistol causing injury near the eye of the informant.
Considering the background and nature of allegation as well as statement of the appellants on oath that
Patna High Court Cr.Misc. No.55597 of 2018(2) dt.03-10-2018 2/2 they have got no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bahadurpur Police Station Case No.188 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
