JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-11-2022 The present petition has been filed for restoring a petition bearing Criminal Miscellaneous No. 16013 of 2022 which has stood dismissed for want of prosecution by an order dated 03.08.2022.

It has been stated in the present petition that on account of inadvertence, the learned counsel for the petitioner was not present in the Court when the case was called out, resulting in dismissal of the aforesaid petition for want of prosecution.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition, I deem it fit and proper to direct for restoration of the aforesaid
