30-09-2016 Heard Sri Ajay Kumar Singh-I, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 06-06-2016 in Phulwari Sharif P.S. Case No. 313 of 2016 registered for offence under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act, 1959, has prayed for grant of bail.
Learned counsel for the petitioner, at the very outset, has drawn my attention to the statement made in paragraph - 3 of the petition that petitioner is having clean antecedent. He further submits that petitioner's name has come in confessional statement of accused, who was apprehended by the police on an allegation that he alongwith four others had assembled for committing
Patna High Court Cr.Misc. No.40902 of 2016 (2) dt.30-09-2016 2/2 dacoity and they were preparing for committing dacoity. From possession of the said accused, one country-made pistol with cartridge was recovered. Save and except, confessional statement of co-accused, there is no material against the petitioner. Keeping in view the fact that name of petitioner has come on confession as well as clean antecedent of the petitioner, let the petitioner namely Randhir be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Phulwari Sharif P.S. Case No. 313 of 2016.
