The petitioner seeks bail in Marhowrah P.S. Case No.281 of 2017 registered under Sections 461, 379 and 411 of the Indian Penal Code.
As per the prosecution case, some scrapped part of the machine of a closed sugar mill is said to have been stolen by some miscreants and 14 pieces of Tawa (part of the machine) was recovered from the Tempo of the petitioner.
It is submitted by learned counsel for the petitioner that one Guddu Singh, scrappers, had loaded the said Tawa on his Tempo and seeing the police force had left the scene leaving the said Tawa in the Tempo and the petitioner was apprehended by the police. The petitioner has no concern with the said Tawa. He is only driver of the said Tempo. The petitioner has been languishing
Patna High Court Cr.Misc. No.38100 of 2017 (02) dt.10-08-2017 2/2 in custody since 04.07.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran in connection with Marhowrah P.S. Case No.281 of 2017.
