JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-47 of the Bihar Excise Act.

Eighteen bottles containing 200 ml. each countrymade liquor are said to have been recovered from possession of the petitioner, for which, the petitioner is languishing in jail custody since 31-02-2016.

Learned counsel for the petitioner submits that nothing was recovered from conscious possession of the petitioner and that is the reason, the seizure list does not bear signature of the petitioner. Moreover, the petitioner does not have any criminal

Patna High Court Cr.Misc. No.38696 of 2016 (2) dt.19-09-2016 2/2 antecedent and the petitioner being a lady, is languishing in jail custody since long.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ramnagar P.S. Case No. 182 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran.
