The petitioners seek regular bail in connection with Bahera P.S. Case No. 44 of 2016 registered for the offences under Sections379/ 34 of the Indian Penal Code. As per FIR, it has been alleged that the sister and aunt of the informant went to Ashapur Chowk in Bank of India and encashed Rs. 45,000/- and, when they were returning, two boys on a motorcycle snatched the same and fled away.

Learned counsel for the petitioners submits that the petitioners are non-FIR named accused persons. They have been falsely implicated and arrested in the present case and their confessional statement has been recorded by the police forcefully, and only after this case, they have been made accused and remanded in two other pending cases and they are in custody since 08-07-2016, hence they have been suitably punished.

Patna High Court Cr.Misc. No.45634 of 2017 (2) dt.19-09-2017 Having regard to the facts and circumstances of the present case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S.
