JUSTICE SUDHIR SINGH ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.
Allegation is that some motorcycle borne unknown criminals snatched Rs. 4,90,000/-, which was to be distributed amongst the old age pensioners, from the informant at the point of pistol.
It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 2.7.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is named in the F.I.R. Earlier case was instituted for offence under Section 392 of the Indian Penal Code. The name of petitioner has come in the confessional statement of co-accused. Thereafter, Chargesheet was submitted for offence under Section 395 of the Indian Penal Code. Petitioner was put on T.I.P. and he was not identified by the witnesses.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.50258 of 2016 (2) dt.21-11-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-II, Bettiah, in connection with Yogapatti P.S. Case no. 124 of 2016.
