JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2016 Heard Sri Raghvendra Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, with clean antecedent as stated in paragraph- 3 of the petition and in custody since 28.6.2016 has prayed for grant of bail in Katihar Rail P.S. Case No. 48 of 2016 registered for the offence under Section 414 of the Indian Penal Code .

By way referring to statement made in paragraph no. 11 of the petition it was submitted by learned counsel for the petitioner that the recovered suitcase was not claimed by any other person rather it was suitcase of the petitioner and even

Patna High Court Cr.Misc. No.42947 of 2016 (2) dt.06-10-2016 2/2 then police arrested the petitioner on accusation of recovery of stolen article.

Keeping in view the nature of accusation and antecedent of the petitioner, let the petitioner Md. Subhan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Katihar / concerned court in connection with Katihar Rail P.S.
