The petitioner seeks bail in Jamui P.S. case No. 249 of 2016 under Section 385, 386 of the Indian Penal Code. The informant alleged that from mobile No.

7070008332 and mobile No. 7564801690 he received call on which the caller demanded extortion.

The learned counsel for the petitioner submits that petitioner is innocent and he has, in fact, committed no offence. The petitioner has falsely been implicated in the case at the instance of the person in whose name the mobile and SIM stand. Neither the mobile nor the SIM is in the name of the petitioner. The police took the statement of Neha Kumari under Section 164 of the Cr. P. C. Neha Kumari disclosed that Pravin Yadav took her

Patna High Court Cr.Misc. No.54270 of 2016 (3) dt.27-02-2017 2/2 mobile and from which the call was made but the I.O. has not traced out the SIM and recorded confessional statement of the petitioner.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in Jamui P.S. Case No. 249 of 2016.
