JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2022 In pursuance to the earlier order of this Court dated 11.11.2022, the District Magistrate, Patna and the Senior Superintendent of Police, Patna have filed their respective counter affidavits and have stated that the encroachment in question has already stood removed, which is not disputed by the learned counsel appearing for the petitioner.

Patna High Court CWJC No.14605 of 2022(3) dt.28-11-2022 2/2 The learned counsel for the RespondentState has further submitted that the then SHO, Bihta Police Station and two Sub-Inspector of Police of the concerned area have already been suspended and departmental proceedings are going to be initiated against them.

Having regard to the facts and circumstances of the case, this Court deems fit and proper to dispose of the present writ petition, however, with an observation that in case, the aforesaid encroachment in question resurfaces, the District Magistrate, Patna and the Senior Superintendent of Police, Patna, shall be held accountable for the same and appropriate proceedings shall be initiated against them.
