The petitioner is alleged to have been entrusted a sum of Rs.5,50,000/- for construction of school building, but the petitioner did not construct the building on one pretext or the other.

It is submitted that the petitioner has already deposited Rs. 266280.00-vide Cheque No. 468713. The petitioner is ready to deposit the remaining amount within one month. In case the petitioner deposits the entire amount within four weeks, in that event it is directed that in the event of arrest or surrender within four weeks in the court below from the date of

No.40790 of 2014 (3) dt.01-04-2015 2 / 2 receipt/production of a copy of this order, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. 251/14, subject to the conditions as laid down under section 438(2) Cr. P.C.
