JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 120B and 34 of the Indian Penal Code. Allegation against petitioner is that she had illicit relation with co-accused Shambhu Yadav and on protest being made by the deceased, who was husband of petitioner and father of informant, he was killed.

It has been submitted on behalf of petitioner that he is in custody since 19.3.2016. Chargesheet has been submitted against petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been named in the F.I.R. merely on the basis of suspicion. There is other substantive evidence to suggest his implication in the present case. Other co-accused, has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.53444 of 2016 (2) dt.16-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar, learned Judicial Magistrate, 2nd Class, Munger, in connection with Tarapur P.S. Case no. 31 of 2016.
