The petitioner seeks bail in a case registered for the offence under Section 394, 302 of the Indian Penal Code. Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation. Till date, petitioner has not been put on T.I.Parade. Similarly situated co-accused Piyush Kumar has already been granted bail by this Court, vide order dated 18.04.2022 passed in Cr.Misc. No. 65481 of 2021. Petitioner claims clean antecedent and he is in custody since 21.05.2021.

However, learned A.P.P. for the State vehemently opposed the bail petition and submitted that during course of investigation, from the house of this petitioner, Purse, Aadhar Card, Voter ID Card and Driving license of the truck driver (since deceased) have been recovered.

Patna High Court CR. MISC. No.66262 of 2021(3) dt.19-04-2022 2/2 Considering the aforesaid facts and circumstances, the prayer for bail of petitioner is rejected. However, since the petitioner is in custody since 21.05.2021, the learned trial court is directed to expedite the trial.
