JUSTICE SANJAY PRIYA ORAL ORDER 12-09-2018 Heard learned counsel for the petitioner and the informant who has appeared after filing vakalatnama. This petition has been filed for modification of the order dated 4.7.2018 passed in Cr. Misc. no. 39063 of 2018. Learned counsel for the petitioner has submitted that petitioner has been granted anticipatory bail vide order dated 4.7.2018 passed in Cr. Misc. no.39063 of 2018 but the petitioner could not surrender in time as he was suffering from Lumber Back-ache since 15.8.2018. He has enclosed the medical certificate in support of such statement as Annexure-1 to the application.

In such circumstances, three week's further time is

Patna High Court Cr.Misc. No.56516 of 2018(2) dt.12-09-2018 2/2 granted to the petitioner from the date of receipt of copy of this order to surrender in the Court below in connection with Complaint case no. 2981 of 2017 pending in the court of learned ACJM, Patna and in that event the petitioner will be released on same terms and conditions as mentioned under order dated 4.7.18 passed in Cr. Misc. no. 39063 of 2018. It is made clear that no further extension of time to surrender shall be granted to petitioner on any ground whatsoever.

This Cr. Misc. petition is allowed.
