2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 341, 406 & 420 of the I.P.C.

3. The present case has arisen by virtue of complaint case of the year 2010 in which N.B.W. has been issued in the year 2023.

4. Learned counsel for the petitioners submits that the petitioners are law abiding citizens and they shall appear on day to day basis before the Court.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No. 59031 of 2023(2) dt.20-09-2023 2/2 bail and submits that in the light of the undertaking that the petitioners shall appear on each and every date before the Trial Court and they shall not create any hurdle in the trial, their prayer for bail shall be considered.

6. In the present facts and circumstances of the case and the submissions made above, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks' from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Complaint Case No. c 1005 of 2010, subject to the condition that the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bonds by the Trial Court itself with further condition as laid down under Section 438(2) of the Cr.P.C.
