JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-04-2022 Heard the parties through virtual Court proceedings. Learned counsel for the petitioners undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, office will place the matter before the Bench. Petitioners apprehend their arrest in connection with a case registered for the offence punishable under sections 147, 149, 341, 323, 354, 379, 504, 506 of the IPC and section 37(c) of the Bihar Prohibition and Excise Act.

Allegedly, after consuming liquor, on the point of pistol, the accused persons including the petitioners assaulted and tried to outrage the modesty of the informant. They also took away her valuable gold ornaments.

No.67434 of 2021(2) dt.01-04-2022 2/2 Learned counsel for the petitioners submits that petitioners are quite innocent and have not committed any offence as alleged in the FIR. They have been falsely implicated in this case due to enmity. There is a case and counter-case between the parties. It is alleged that after consuming liquor, on the order of petitioner Ram Bahadur Mandal, other accused persons assaulted the informant. There is no injury sustained by anyone, as per the FIR itself. There is no specific allegation against the petitioners of consuming liquor. Petitioners have no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioners, named above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Hathauri P.S. Case No.27 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
