JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-09-2017 The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 332 of 2016, registered for offences punishable under Sections 304B, 120B/34 of the Indian Penal Code.

Petitioner is husband of the deceased and allegation against him is of committing dowry death of the deceased. It has been submitted on behalf of the petitioner that save and except suspicion, there is nothing against the petitioner and in fact the deceased died due to the fact that she fell down near chapakal and petitioner has been in judicial custody since 04.09.2016 and trial has commenced in this case and two witnesses have been examined.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.41331 of 2017 (2) dt.07-09-2017 Having heard both sides, having heard both sides, considering the facts and circumstances, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly rejected.

However, as submitted by learned counsel for the petitioner that trial has commenced and two witnesses have been examined, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of seven months.
