Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Deceased Nagendra Paswan had entered into love marriage with this petitioner. Before his death Nagendra Paswan had informed to the informant on telephone that co-accused Bahadur Paswan, Sanjay Paswan and Dharmendra Paswan had surrounded him and they want to kill him. Later on dead body of Nagendra was found hanging from a tree.
Learned counsel for the petitioner submits that the post-mortem report would reveal that the Doctor has not ruled out the case of hanging. However, viscera has been sent for chemical examination.
Patna High Court Cr.Misc. No.42598 of 2016 (3) dt.13-12-2016 Considering the aforesaid facts as well as the fact that the petitioner is a female and there is no strong material against the petitioner to commit murder of lover, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghatti, Gaya/Successor Court in connection with Sherghatti P.S. Case No. 128 of 2016.
