JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Jai Kishun Yadav @ Jai Krishna Yadav is in custody since 30.05.2016 in Gwalpara P.S. Case No. 37 of 2016 under Sections 147, 148, 149, 341, 323, 325, 307, 379, 427, 504, 506 of the Indian Penal Code.

The allegation against this petitioner is that he along with co-accused persons and unknown 15-20 persons surrounded and damaged the vehicle of the informant with lathi, gun, danda and one co-accused with his brother-in-law dragged the informant from the vehicle with intention to kill him and attacked on him. According to the learned counsel for the petitioner, the injuries are simple in nature.

Patna High Court Cr.Misc. No.38951 of 2016 (2) dt.17-09-2016 Considering the nature of allegation that there were 1520 members in the mob and the injuries caused are only simple in nature, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Judicial Magistrate 1st class, Udakishunganj, District-Madhepura in connection with Gwalpara P.S. Case No. 37 of 2016.
