The petitioner seeks bail in a case under Section 406, 420 and other sections of the Indian Penal Code. Md. Sikander took Rs. 2, 70,000/- from the complainant, Mumtaz Beg. When the complainant demanded receipts the petitioner and Sheikh Kabir assured that they are guarantors and his money would be returned.

It is submitted that Md. Sikander, who received the money from the complainant/ informant, moved before this court for anticipatory bail and his arrest has been stayed. The petitioner neither received the money nor played any role except that he gave assurance to the complainant/ informant and for that the petitioner

Patna High Court Cr.Misc. No.30985 of 2015 (2) dt.17-08-2015 2/2 is in jail since 09.06.2015.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deo Kumar, learned Judicial Magistrate, 1st class, East Champaran, Motihari in Sugauli P.S. Case No. 418/2014.
