JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Saharsa S.C./S.T. P.S. Case No. 14 of 2014 registered for the offences punishable under Sections 341, 323, 504, 506/34 of the Indian Penal Code and Section 3 (i) (x) (xi) of S.C./S.T. (Prevention of Atrocities) Act.

Paragraphs no. 82 and 86 of the case diary reveal that during course of investigation petitioner was noticed by the investigating officer and in pursuant to the aforesaid notice, he appeared before the investigating officer and thereafter, he was released after execution of bonds.

In the aforesaid circumstance, this petition stands

Patna High Court Cr.Misc. No.39989 of 2014 (3) dt.23-06-2015 disposed of with direction to petitioner to surrender before the court of Sri D. Kumar, Judicial Magistrate 1st Class, Saharsa/concerned court in connection with Saharsa S.C./S.T. P.S. Case No. 14 of 2014 within four weeks from today and if petitioner does so, the concerned court shall pass appropriate order on the prayer of the petitioner keeping in mind the principle as laid down by a Bench of this Court in Mahendra Singh vs. State of Bihar reported in 2004(3) PLJR, 491.
