JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kishanganj P.S. Case No. 426 of 2016 instituted for the offence under Sections-25(1-A)(1-AA), 26/35 of the Arms Act and 420, 467, 468 of the Indian Penal Code. From the seizure list enclosed with the FIR, it appears that one loaded magazine with two live cartridges were recovered from possession of the petitioner. He is said to be in custody since 10-092016. It has been submitted that the co-accused, namely, Kundan Kumar, Chandan Mandal @ Chandan Kumar and Bittu Kumar have already been granted bail by coordinate benches of this court vide orders dated 24-11-2016, 04-04-2017 & 06-07-2017 20-06-2017 passed in Cr. Misc. Nos. 50390 of 2016, 7024 of 2017 & 27956 of 2017 receptively.

In such circumstances, prayer for bail is allowed. The

No.37893 of 2017 (2) dt.09-08-2017 petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kishanganj P.S. Case No. 426 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Kishanganj subject to condition that both the bailors should be close relative of the petitioner.
