2. The petitioner who is in custody since 19.08.2014 has renewed his prayer for bail in connection with Buxar (M) P.S. Case No. 111 of 2014 for the offences alleged under Sections 302, 201, 120B and 34 of the Indian Penal Code.
3. It is submitted that the petitioner being the father-in-law of the deceased lady has been in custody since 19.08.2014. The thrust of the accusation in the FIR is against the husband of the deceased whereas no specific overt act has been attributed to the petitioner. It is further submitted that the petitioner's case stand on better footing than that of the
Patna High Court Cr.Misc. No.32636 of 2015 (2) dt.09-12-2015 co-accused Shyamji Singh who has since been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 20453 of 2015.
4. Having regard to the entirety of the facts and circumstances of the case as well as the period of custody by the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Sri U.K. Upadhyay, learned Additional Sessions Judge-VI, Buxar in connection with Buxar (M) P.S. Case No. 111 of 2014 corresponding to the Sessions Trial No. 363 of 2014 subject to the condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
