2. At the outset, learned counsel for the petitioners submits that during pendency of this application, the petitioner Nos. 2 & 4 have been taken into judicial custody. Hence this application with regard to the petitioner Nos. 2 & 4 has become infructuous.

3. Accordingly, this application filed in connection with regard to the petitioner Nos. 2 & 4 stands dismissed as

Patna High Court CR. MISC. No.55504 of 2025(3) dt.10-11-2025 2/3 being infructuous.

4. The petitioner Nos. 1 & 3 are apprehending their arrest in Bakhtiyarpur P.S. Case No. 84 of 2025 registered under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of BNS and 27 of the Arms Act.

5. Allegedly, while the informant was taking meal at his Dalan, the accused persons came there and started abusing him and on protest, the accused persons assaulted the informant with different weapons as a result of which, the informant sustained injury. It is also alleged that when the nephew of the informant came to rescue, he was also assaulted. Firing was also made in the occurrence.

6. It has been submitted on behalf of the petitioner Nos. 1 & 3 that the petitioners are innocent and they have falsely been implicated in this case. The nature of injury is simple. The matter has been compromised between the parties.

7. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

8. Considering the aforesaid facts and circumstances, let the petitioner Nos. 1 & 3, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on

Patna High Court CR. MISC. No.55504 of 2025(3) dt.10-11-2025 3/3 furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Barh, Distt. Patna in connection with Bakhtiyarpur P.S. Case No. 84 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of BNSS, 2023.
