JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in the statement of some witnesses, who expressed their suspicion against the petitioner and others and after that one co-accused, Lalo Yadav was arrested and made his confessional statement disclosing the involvement of the petitioner. Petitioner does have criminal antecedent of near about five cases and investigation against him has already been completed but except the aforesaid confessional statement, suspicion as well as criminal antecedent,

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Ashok Kumar, Judicial Magistrate 1st Class, Uda Kishunganj, Madhepura in connection with Gwalpara P.S. Case No. 102 of 2014.
