The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 25.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that the accused persons including the petitioner came at the door of the informant and sat behind the canal where the informant was also sitting. On objection by the informant, accused Laxman Bind assaulted by Trishul on head

Patna High Court CR. MISC. No.66606 of 2021(2) dt.13-04-2022 2/3 of the informant and petitioner assaulted by iron rod causing injury.The informant was taken to hospital by the villagers from where he was referred to Varanasi.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. The F.I.R. does not even remotely suggest that as to why the occurrence had taken place, except the fact that the informant objected the accused seating behind the canal. It is further submitted that Laxman Bind has been granted bail by the learned Court below by order dated 24.08.2021 in B.P. No.1020 of 2021, who has been alleged to have assaulted the informant by Trishul on his head. As far as this petitioner is concerned, it is alleged that he assaulted by iron rod, but not on vital part of the body.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and co-accused has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
