Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Ujiyarpur P.S. Case No. 187 of 2023 registered for the offences under Section 30(a), 41(i) and 41 (ii) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. It is also submitted that the petitioner is neither the owner of nor the driver of the alleged truck bearing Reg. No.- UP 86T3683 and motorcycle bearing Reg. No.-BR33 AS4718. He has no criminal antecedent.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.62255 of 2023(2) dt.16-10-2023 2/2 case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Special Judge, Excise I, Samastipur in connection with Ujiyarpur P.S. Case No. 187 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
