The petitioners seek bail in anticipation of their arrest in connection with Palasi P.S. Case No. 138 of 2018 dated 01.06.2018 instituted for the offences under Sections 363 and 366 of the Indian Penal Code.
Some of the petitioners, namely, Shrawan Ram, Kundan Ram, Sonu Kumar and Kishore Ram are alleged to have taken away the daughter of the informant for immoral purposes.
Patna High Court Cr.Misc. No.55910 of 2018(2) dt.10-12-2018 2/3 The aforesaid F.I.R. was lodged after a delay of 15 days of the disappearance of the daughter of the informant. During the course of investigation, the statement of the daughter of the informant / victim was recorded under Section 164 of the Code of Criminal Procedure, wherein she has specifically stated that she has married petitioner no. 3 of her own volition and that nobody has kidnapped her. A petition with similar averment has also been filed by the so called victim girl before the court below on 16.06.2018.
Presently, learned counsel for the petitioner has submitted that the daughter of the petitioner is staying as married wife of petitioner no. 3.
The age of the victim has been assessed to be 18 to 19 years.
Considering the aforesaid facts as also taking into account the fact that the petitioners do not have any criminal antecedents, they, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of

No.55910 of 2018(2) dt.10-12-2018 3/3 receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Araria in connection with Palasi P.S. Case No. 138 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
