Petitioner, Shukar Hansda, is in custody since 21.04.2016 in Khaira P.S. Case No. 58 of 2003 registered under Sections 364, 201/34 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submitted that according to the prosecution case, the son of the informant was returning with this petitioner and other accused persons and thereafter his son became traceless but his bag was found in other house. Subsequently, his dead-body was found recovered, therefore, Section 302 of the Indian Penal Code was added. Co-accused, Jehal Ravidas, faced trial and has already been acquitted. The other co-accused, Ghanshyam Ravidas, whose case is on same footing as that of the petitioner has already been granted bail by this Court in Cr. Misc. No. 16752 of 2016 on 04.05.2016.

In view of the nature of allegation and the fact that one co-accused after facing trial has already been acquitted and the other co-accused has already been granted bail and that the case of this petitioner is on same footing, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.
