The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 413, 414, 279, 337, 338, 429 and 34 of the Indian Penal Code and Section 11 (D) of the Animal Prevention of Cruelty Act and Sections 182(A), 183, 184, 192, 192 (a) of the M.V. Act.

The petitioner is Truck driver and was carrying the Truck in which unauthorized cattle were found, some of them were found dead and some were in writhing.

Learned counsel for the petitioner submits that the petitioner is only Truck driver and he is not the owner of the Truck.

No.56265 of 2018 (2) dt.20-09-2018 2 /2 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Salim @ Serajuddin Shah, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No.426 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
