JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is father whereas petitioner no. 2 is step- mother of the deceased and it would appear from perusal of the first information report that the mother of the deceased had died 19 years back and after that petitioner no. 2 solemnized his marriage with petitioner no.1. The accusation against the petitioners is that they called the deceased and committed his murder.

Submission on behalf of the petitioners is that the dead body of the deceased was recovered from a canal and no doubt,

No.38592 of 2016 (2) dt.17-09-2016 2/2 some injuries were found on the wrist of the deceased but no one has seen the actual killing of the deceased and petitioners had no motive to commit the murder of the deceased. It is further submitted that charge sheet has already been submitted and petitioners are in jail custody since 11.06.2016. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.Case No. 481 of 2013.
