====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 26-10-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Nawada Town P.S. Case No. 433 of 2024 dated 25.03.2024 registered for the offence punishable under Section 394 of the I.P.C.
3. As per the prosecution case, some unknown persons assaulted the informant who is a delivery boy and on the point of katta, snatched Rs. 15,000/- from him. They also fired and fled away from the place of occurrence.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.60472 of 2024(3) dt.26-10-2024 2/3 present case. The petitioner is not named in the F.I.R. His name has come in the present case during investigation only on the basis of suspicion as he was seen in CCTV footage near the place of occurrence. No incriminating article has been recovered from his possession. He was not apprehended on the spot. He was not put on T.I. Parade. He has no concern with the alleged offence. The petitioner has eight criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 17.05.2024. 5.Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Nawada Town P.S. Case No. 433 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are
Patna High Court CR. MISC. No.60472 of 2024(3) dt.26-10-2024 3/3 liable to be cancelled.
