The petitioner seeks bail in a case registered for the offences punishable under sections 392 of the Indian Penal Code and section 27 of the Arms Act. Later on sections 395 and 412 of the Indian Penal Code were added.

The petitioner is not named in the F.I.R. The name of the petitioner figured in the case in the confessional statement of Nand Kishore Sah from whose house Rs.98,000/- being the looted money was recovered. Similarly other accused persons, namely, Santosh Kumar, Ratan Prasad Kashyap, Mohan Yadav and others were arrested and they have also confessed their guilt. The petitioner was also arrested and he is also said to have confessed but no looted money was recovered from his

Patna High Court Cr.Misc. No.30223 of 2015 (2) dt.12-08-2015 possession. Similarly, situated co-accused Bablu Singh has already been granted bail by order dated 29.07.2015 vide Criminal Misc. No. 26408 of 2015.

Considering the facts aforesaid, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Samastipur in connection with Rosera P.S. Case No. 279 of 2014 corresponding to Sessions Trial No. 164 of 2015.
