2. The petitioner has preferred this application for grant of regular bail in connection with Thakurganj P.S. Case No. 243/2023 dated 25.11.2023 registered for the offence punishable u/s 341, 323, 307, 504, 506 and 379 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, on 24-11-2023 at about 6.30 P.M. the informant's husband was busy in business and saw that someone is taking away his bike. Then he asked why they were taking his bike. Thereafter, the petitioner and two accused persons started abusing and assaulting the informant's husband. Patna High Court CR. MISC. No.57100 of 2025(2) dt.25-08-2025 2/3 accused Md. Afaque assaulted her husband with iron rod on his head and wrist. The co-accused, Md. Afaque also assaulted on his nose. Thereafter, nearby villagers informed her about the incident, then she saw her husband in P.H.C. It is further alleged that the accused persons also snatched Rs. 48,000/- from her husband.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that the injured sustained four injuries upon his scalp, face, over right eye and right hand and out of four injuries two injuries are grievous in nature. The specific allegation of assault is against the co-accused, Md. Afaque. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
