12.08.2015 Heard learned counsel for the Petitioner and the State.
The Petitioner seeks bail in Mohiuddin Nagar P.S. Case No. 39 of 2015 (G.R. No. 391 of 2015) registered under Section 376 of the Indian Penal Code and Sections 4/6 of POCSO Act pending before the 1st Additional Sessions Judge, Samastipur.
Considering the nature of allegations, I am not inclined to grant bail to the Petitioner. The prayer for bail is rejected.
The Trial Court is directed to hold the trial on day to day basis in view of the direction of the Hon'ble Supreme Court and for which reason he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this
Patna High Court Cr.Misc. No.30646 of 2015 (2) dt.12-08-2015 order, to the Superintendent of Police, Samastipur, and the Superintendent of Police, Samastipur is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
