JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is a case of misuse of privilege of bail and it appears that the bail bond of the petitioner was cancelled on 19.04.2000 and on the strength of permanent warrant issued against him the petitioner could be remanded in this case on 24.03.2015 but one thing is obvious from the materials available on the record that Dehri P.S. Case No. 276 of 1991 was registered in the year 1991 and petitioner made his pairvi till the year 2000 and on 19.04.2000, a petition under Section 317 of the Cr.P.C. had been filed on behalf of the petitioner but unfortunately, the aforesaid petition was rejected and thereafter, his bail bond was

Patna High Court Cr.Misc. No.32924 of 2015 (2) dt.18-08-2015 2/2 cancelled.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sasaram in connection with Dehri P.S. Case No. 276 of 1991.
