In this case, the petitioner is seeking anticipatory bail in connection with Hathua P.S. Case No.127 of 2018, registered for the offence punishable under Section 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
From a deserted motorcycle 360 ml. whisky has been recovered.
Looking to the facts and circumstances of the case and also considering the quantum of recovery of whisky, let the petitioner, namely, Anand Kumar Singh @ Anand Singh, be released on anticipatory bail in the event of his arrest or
Patna High Court Cr.Misc. No.56609 of 2018(2) dt.20-09-2018 2/2 surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Second Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj, in connection with Hathua P.S. Case No. 127 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
