This is a petition for grant of anticipatory for offence under Section 379 of the Penal Code. The only material against the petitioner is that his mobile was theft away and said to have been used with the sim of petitioner. The learned counsel for the petitioner submits that the occurrence of theft has taken place one year earlier and the petitioner was not aware about the use of the said mobile and sim.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each

Patna High Court Cr.Misc. No.40379 of 2014 (3) dt.23-04-2015 2/2 in connection with the Kiul P.S. Case No. 52 of 2013 to the satisfaction of the Judicial Magistrate, Kiul, Railway Court, Lakhisarai, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
