The petitioner apprehends his arrest in connection with Dehri (Indrapuri) P.S. Case No. 338 of 2018 registered under Sections 341, 323, 504, 506/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He is innocent and has falsely been implicated in this case due to ulterior motive. There is a land dispute between the parties, for which Title Suit No. 710 of 2007 (Annexure-3) is pending in the Court below. Moreover, no firearm injury is found in alleged occurrence.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.54209 of 2018(2) dt.12-09-2018 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Dehri, Rohtas in connection with Dehri (Indrapuri) P.S. Case No. 338 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
