JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State.
The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 467, 468, 423/120(B) of the Indian Penal Code.
Allegedly, the petitioners in conspiracy with each other with an intention to grab the share of the complainant filed a case in Lok Adalat showing the complainant dead and obtained forged award from the Lok Adalat.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.43144 of 2014 (2) dt.20-03-2015 2/2 informant has opposed the prayer for bail and has submitted that the petitioners do not deserves the privilege of anticipatory bail as they being abused the process of law. Under the facts and circumstances of the case, I direct the petitioner nos. 1 to 3, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Sasaram (Model) P.S. Case No. 622 of 2013 (G.R. No. 1231/2013), subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
Grant of bail, however, is subject to the condition that the petitioners shall appear before the court below as and when required and if they fail to do so on two consecutive occasions, their bail bonds shall be liable to be cancelled by the court below itself.
